Carter Cosponsors Bill to Block CMS Vaccine Mandates

WASHINGTON, D.C.—Congressman Earl L. "Buddy" Carter (R-GA) continues his charge against federal COVID-19 vaccine mandates, specifically as it related to Centers for Medicare & Medicaid Services (CMS) employees, by signing onto Rep. Jeff Duncan's (R-SC) recent resolution under the Congressional Review Act (CRA) that will halt President Biden’s harmful mandate for virtually all healthcare employees. Resolutions under the CRA are privileged under Congressional rules to ensure Congress is able to keep the Executive branch accountable. A CRA resolution requires a simple majority threshold to pass the House and Senate.

“Vaccine mandates are unconstitutional. As we head into Christmas, workers need the peace of mind that comes with keeping their jobs and keeping the President out of their personal medical decisions. That’s why I am a proud cosponsor of this bill and proudly defend our health care workers’ right to decide with their doctor whether the COVID-19 vaccine is the right decision for them,” said Carter.

Rep. Carter joins 160 of his colleagues in co-sponsoring this legislation to prevent any further unconstitutional overreach from the Biden Administration.

Background: The Congressional Review Act process is the legal process whereby Congress can overturn an Administration regulation, once it has been properly noticed. “Proper notice” occurs once a regulation is printed in the Federal Register and received by the Clerks of the House and Senate. The CMS vaccine mandate regulation was printed in the Federal Register on November 5, 2021. It was noted as received by the Senate Clerk on December 1, 2021, and by the House Clerk on December 9, 2021. Now that all three of those notices have been received, a CRA receives privilege in the House if the Minority Leader brings it up as a “privileged resolution,” which means the House must bring the legislation to the floor for a vote.
